1) LEGAL NOTICE OF USE: Data collection on the website (LSSICE + LOPD + GDPR)

In compliance with the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, we inform you that the data you provide will be processed by the commercial entity “Grupo La Costa” (GESTIÓN INMOBILIARIA MALAGUEÑA SIGLO XXI, S.L., with CIF B93505592), with its commercial address at Carril del Siroco, 8 Local 1, 29630 Benalmádena Costa, Málaga, for the purpose of providing the requested and/or contracted service, and performing the necessary procedures. The legal basis for processing your data is the execution of the service you have contracted and/or requested. The prospective offer of products and services is based on the consent you provide, without affecting the execution of the contract should you withdraw this consent. The data provided will be retained while the commercial relationship is maintained or for the years necessary to comply with legal obligations. The data will not be shared with third parties, except where there is a legal obligation. You have the right to obtain confirmation about whether “Grupo La Costa” is processing your personal data and, therefore, have the right to exercise your rights to access, rectify, limit processing, portability, object to processing, and erase your data, as well as the right to lodge a complaint with the Control Authority by sending a written request to the above postal address or to the email contact@grupolacosta.com, attaching a copy of your ID in both cases. Additionally, we request your authorization to offer you products and services related to those requested, provided, and/or marketed by our entity, and to thereby retain you as a client.

2) USERS:

Access to and/or use of this “Grupo La Costa” portal grants the status of USER, who accepts, from such access and/or use, the General Terms of Use outlined here. These Terms will apply regardless of the General Terms of Contracting that may be mandatory.

3) USE OF THE PORTAL:

Lacostapropiedades.com provides access to a multitude of information, services, programs, or data (hereinafter, “the content”) on the Internet belonging to “Grupo La Costa” or its licensors to which the USER may have access.

The USER assumes responsibility for the use of the portal. This responsibility extends to the registration that may be necessary to access certain services or content. In this registration, the USER will be responsible for providing truthful and lawful information. As a result of this possible registration, the USER may be provided with a password for which they will be responsible, committing to use it diligently and confidentially.

The USER undertakes to make appropriate use of the contents and services that "Grupo-Costa del Sol" offers through its portal, and, by way of example but not limited to, not to use them for:

(I) Engaging in unlawful, illegal, or activities contrary to good faith and public order.

(II) Spreading content or propaganda of a racist, xenophobic, illegal pornographic, terrorist-apologetic, or human rights-violating nature.

(III) Cause damage to the physical and logical systems of “Grupo La Costa,” its suppliers, or third parties, introduce or spread computer viruses or any other physical or logical systems capable of causing the aforementioned damage.

(IV) Attempt to access and, if applicable, use the email accounts of other users and modify or manipulate their messages. “Grupo La Costa” reserves the right to remove any comments and contributions that violate respect for the dignity of individuals, that are discriminatory, xenophobic, racist, pornographic, that harm youth or children, disrupt public order or safety, or that, in its opinion, are not suitable for publication.

In any case, “Grupo La Costa” shall not be responsible for the opinions expressed by users through forums, chats, or other participation tools.

4) DATA PROTECTION

“Grupo La Costa” complies with the guidelines of Organic Law 15/1999 of December 13 on the Protection of Personal Data, Royal Decree 1720/2007 of December 21, which approves the Regulation for the development of the Organic Law, and other applicable regulations in force, including GDPR 2018, and ensures the proper use and processing of users’ personal data.

To this end, alongside each personal data collection form in the services that the user may request from “Grupo La Costa,” the user will be informed of the existence and acceptance of the specific conditions for the processing of their data in each case. 5) INTELLECTUAL AND INDUSTRIAL PROPERTY:

“Grupo La Costa,” either directly or as an assignee, holds all intellectual and industrial property rights to its website, as well as to the elements contained therein (including, but not limited to, images, sound, audio, video, software, or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access, and use, etc.), which are owned by “Grupo La Costa” or its licensors. All rights reserved. Under the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution, and public communication, including its provision, of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, are expressly prohibited without the authorization of “Grupo La Costa.” The USER agrees to respect the intellectual and industrial property rights owned by “Grupo La Costa.” The USER may view the elements of the portal and even print, copy, and store them on their computer’s hard drive or any other physical medium, solely for personal and private use. The USER must refrain from deleting, altering, circumventing, or manipulating any protection device or security system installed on the “Grupo La Costa” pages.

6) EXCLUSION OF WARRANTIES AND LIABILITY:

“Grupo La Costa” shall not be liable, under any circumstances, for damages of any kind that may arise, including but not limited to: errors or omissions in the content or images provided by users, unavailability of the portal, or the transmission of viruses or malicious or harmful programs in the content, despite having taken all necessary technological measures to prevent such issues.

7) MODIFICATIONS:

In the event that lacostapropiedades.com contains links or hyperlinks to other websites, “Grupo La Costa” will not exercise any control over those sites and their content. Under no circumstances shall “Grupo La Costa” assume any responsibility for the content of any link belonging to an external website that it does not control, nor will it guarantee the technical availability, quality, reliability, accuracy, completeness, truthfulness, validity, and legality of any material or information contained in any of these hyperlinks or other websites. 9) RIGHT OF EXCLUSION;

“Grupo La Costa” reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, whether on its own initiative or at the request of a third party, to users who violate these General Terms of Use.

The validity of these conditions will depend on their exposure and they will remain in effect until they are replaced by other conditions that are duly published.

12) APPLICABLE LEGISLATION AND JURISDICTION:

The relationship between “Grupo La Costa” and the USER will be governed by current Spanish legislation, and any disputes will be submitted to the courts and tribunals of the city of Málaga.
